Techniques of Fake Rental Owners

Unfortunately during our first years of business between 2006-2008, when Holiday Velvet was still offering free advertising for holiday rental owners, we learned first-hand the techniques that fake owners employ to scam holiday makers. When an Australian father of 2 small children flew to New York and called us to ask why the apartment he thought he rented out didn’t exist (yes, this is a true story), we knew we had to take action.

Scammers use free rental portals to advertise “too-good-to-be-true” property deals. Since this New York story we are checking the credentials of every registration we get: unless we are satisfied with the outcome the property doesn’t get published on our website. We are now confident to have eradicated fraud on Holiday Velvet. This doesn’t mean to say that you shouldn’t trust owners that advertise on free websites – 99.9% of our owners have always been professionals. They take up free offers on portals like ours to test whether the website can help with their marketing.

This article gives true examples of the technics these unscrupulous people employ to scam holiday makers and we hope that by reading it you will never fall into their trap.

THE 4 GOLDEN RULES

To check the legitimacy of a holiday rental owner before making a payment we advise you to do ALL of the following:

RULE 1. SPEAK TO THE OWNER ON THE TELEPHONE
* Ask to speak with the person who sent you an email – most scammers used different names on different websites. When you call ask for the person who sent you the email and if you notice an hesitation on the receiver’s part this may be an indication that they are not who they say they are

* Ask in-depth questions about the property (“how far is it from…?”, “what kind of equipment does the kitchen have?”, etc..) – we had a scammer on the phone who hung up after the third question, realising that he was going to get found out.

* Does the person speak good English? – if you have enquired for a top luxurious property in the middle of Manhattan for example, the owner must be someone who speaks good English.

* If you keep on getting an answering machine: ask for the owner to call you back and say you won’t book until you speak to him. Then do the tests above.

RULE 2. ASK FOR REFERENCES FROM PREVIOUS CLIENTS
* If the owner gives you email addresses to contact ask these past clients whether you can speak to them on the phone – scammers have multiple email addresses that they sell to you as references and answer themselves.

RULE 3. TAKE OUT TRAVEL INSURANCE
* Should you get scammed – and we truly hope you won’t – take an extra precaution and find out whether your travel insurance will cover your holiday rental cost.

RULE 4. NEVER ACCEPT TO PAY BY MONEY WIRING TRANSFER
* Western Union payments are untraceable and the preferred method of payment of scammers. A serious owner should have multiple payment options. Your preferred payment option should always be credit card – whether you pay through Paypal or else. With credit card you can easily do reverse charges and are covered by insurance.

* Trouble is most rental owners don’t have credit card facilities (although it is so easy to set up a Paypal account, we don’t know why they don’t) so they will ask you for bank transfers

* Bank transfers: make sure the name of the account is correct by calling the bank prior to paying. Explain to the bank that you don’t know this person personally and they you are worried about making a payment – if they could please confirm that the name you have matches the account number you have. If they say “no it doesn’t match” don’t make the payment.

A HELPFUL TEST

Scammers don’t write original copy, they take it from other adverts. They also steal images from other adverts and put it all together to create that “perfect place” at an unbelievable price and always available. Test whether the advert is original:

- copy a short chunk of the advert text
- paste it in your Google browser adding double quotes on each end, for example “a unique product with 5 bedrooms with king size beds”
- click on the results… (if no result comes up try another sentence). Do the rental adverts you see have different pictures? Is the contact the same?

EXAMPLE EMAILS BY SCAMMERS

Most of the time scammers use a template email that they send to everyone – they don’t even take the time to change it according to your requirements. When they do write something themselves the English is poor.

Example 1
Thanks very much for contacting me, the apartment is situated in Knightsbridge,  on 27 Montpelier Street, LONDON, SW7, GB and is available for your desired dates 19/07/2008 to 22/07/2008. The rent for your  stay is £360 (@ £120 per night)  but to secure the place 50% of the rent will be required plus a refundable security deposit of £300, so all you need pay to secure the place is £480 . I’d also like to know where exactly you’ll be coming from? and for how long will you need the place, I have also attached more pictures of the place with this message ,hope you like them. [...] Let me know about your interest so i can send you a booking/ payment form so you can fill and send it back to me to secure the place.. Thanks and i hope to hear back from you soon, Jeff Krause” (email used: dougholms@googlemail.com , property name used: Central London apt)

» Why does “Jeff” quote a price for the stay and then further on asks “how long will you need the place”? Just doesn’t make any sense. “Let me know about your interest” is something the scammer obviously wrote himself.

Example 2
Also in this example the “owner of a luxury apartment in Chicago” tries to write the email himself – the result is laughable:

“Thanks very much for contacting me, the apartment is situated in Chicago south Loop, 605 S Wabash Ave. Chicago, IL,  60605 and its very much available for your desired dates 29/11/2008 to 03/12/2008, 4-nights and the rent for your stay is $800 (@ $200 per night), You`ll need to Book down the Apartment for your dates, Remember its Important before someone else do…. To secure the Apartment 50% of the rent will be required ($400) plus a refundable security deposit of $600, so all you need pay to book down the Apartment for your Lovely dates is $1000..”

Example 3
In this next template the scammer’s leaves in “yes pets are allowed” but at no time did the person who enquired ask about pets.

“Hi, The apt is a 4 bedroom apt with 4 bathrooms too, fully furnitured and well serviced. daily rate is $140 or you interested in monthly rates. Parking is available I have attached pictures, please note that reservation is on a first come first serve basis. The apt is located on 120 East Houston Street, zip code is 10002, New York. Yes pets are allowed. The dates you required are presently free. Cheers, Anna Polly (email used: anna.polly007@gmail.com)”

Example 4
If you don’t send a response back to the scammer you might get something like this:

“Hello, we have not heard you,if you still interested do let us known as we holding for you… Thanks, Alex Kingsman (alexkingsman4@aol.com)”

YOU GOT SCAMMED – WHAT TO DO NOW

Call your local police - no point calling the police of New York if your rental is in New York, they can’t help. If you were given bank account details by the scammer ask your local police to please get in touch with the bank so procedures can be put in place to shut the account.

Make your travel insurance work - the police report will probably help you get your money back

If you made a bank transfer - call your bank and try and reverse the payment immediately. If the money hasn’t left you may be able to stop it.

    I have been a victim of on-line fraud. I booked an apt in New York and got the same reply as some of the above, It is the same fax number and the same address.We paid the deposit and when we refused to pay more money we havent heard from him since. (The apt appears to be up for sale.) It is a pity we didnt know about this web site before we booked in the future we will be more careful.

    Katherine, We were so glad we decided to do further investigation into this vacation rental in Washington DC, so we Googled this name. The ad contained almost the same exact like yours where you get free pick up service to and from and airport, was a special discount rate for the dates requested plus there were pictures of a great looking high end apartment with free use of the health club and free daily cleaning. We were just about to wire $1K into money gram. Thank you for spreading the word and saving the trouble.

No expense has been spared in this spectacular unit. Within steps of fantastic dining/shopping and the new york times square.     I was just about to pay for an apartment for $1500 for our trip in June at 132 west 58th street. I lived a block away last year and knew that the pictures and looks of this place was unbelievably low priced. So, I googled the email home2rent11@aol.com and this website came up. The English was poor and a lot of the e-mails looked suspicious so I figured I better check it out :( I’m glad I didn’t pay yet..

    6. Tenant shall use the leased premises exclusively for a private residence for occupancy by no more than ten persons, unless otherwise specified herein, and Tenant shall not make any alterations to the house, outbuildings or grounds without written consent of Landlord.
    7. Tenant shall keep the premises in good order and repair and shall advise Landlord or Landlord’s agent of any needed major repairs or maintenance if they arise.
    8. Tenant agrees to take good care of the furniture, carpets, draperies, appliances and other household goods, and the personal effects of Landlord, and further agrees that he will deliver up same to Landlord in good condition at the end of the term of this lease, normal wear and tear expected. Landlord will have the premises professionally cleaned upon departure.
    9. Tenant shall repair or replace, at Tenant’s expense, all loss or damage to any of the listed furniture, carpets, draperies, appliances and other household goods, and personal effects of Landlord, whenever such damage or loss shall have resulted from Tenant’s misuse, waste or neglect of said furnishings and personal effects of Landlord.
    10. Tenant shall cause to be made, at Tenant’s expense, all required repairs to heating and air-conditioning apparatus, electric and gas fixtures and plumbing work whenever such damage shall have resulted from misuse, waste or neglect of Tenant, it being understood that Landlord is to have same in good order and repair when giving possession.
    11. Tenant shall not keep or have in or on the leased house, outbuildings or grounds any article or thing of a dangerous, flammable or explosive nature that might be pronounced “hazardous” or extra hazardous” by any responsible insurance company.
    12. Tenant shall give prompt notice to Landlord or his agent of any dangerous, defective, unsafe or emergency condition in or on the leased premises, said notice being by any suitable means. Landlord or his agent shall repair and correct said conditions promptly upon receiving notice thereof from Tenant.
    13. Landlord covenants that the Tenant and Tenant’s family shall have, hold and enjoy the leased premises for the term of this lease, subject to the conditions set forth herein.
    14. Tenant covenants that he shall not commit nor permit a nuisance in or upon the premises, that he shall not maliciously or by reason of gross negligence damage the house, outbuildings or grounds, and that he shall not engage, nor permit any member of his family to engage, in conduct so as to interfere substantially with the comfort and safety of residents of adjacent buildings.
    15. Tenant agrees to place a Security Deposit with Landlord in the amount $500, to be used by Landlord at the termination of this lease for the cost of replacing or repairing damage, if any, to the house, outbuildings, grounds, furnishings or personal effects of Landlord resulting from the intentional or negligent acts of Tenant.
    16. Landlord agrees to return said security deposit to Tenant within one business days of the Tenant’s vacating the leased premises subject to the terms and conditions set forth herein.
    17. Tenant shall, at reasonable times, give access to Landlord or his agents for any reasonable and lawful purpose. Except in situations of compelling emergency, Landlord or his agents shall give the Tenant at least 24 hours’ notice of intention to seek access, the date and time at which access will be sought, and the reason therefore.
    18. Upon signing of lease, Tenant shall remain liable for all rent due or to become due during the term of this lease. Landlord or his agents shall have the right to re-let the premises in the Landlord’s name upon default, and will apply proceeds of such re-letting toward the reduction of Tenant’s obligations enumerated herein.
    19. In the event of any breach by the Tenant of any of Tenant’s covenants or agreements herein, Landlord or his agents may give Tenant five days’ notice to cure said breach, setting forth in writing which covenants or agreements have been breached. If any breach is not cured within said five-day period, or reasonable steps to effectuate said cure are not commenced and diligently pursued within said five-day period and thereafter until said breach has been cured, Landlord or his agents may terminate this lease upon five days’ additional notice to the Tenant, with said notice being in lieu of a Notice to Quit, which Tenant hereby waives.
    20. Said termination shall be ineffective if Tenant cures said breach or commences and diligently pursues reasonable steps to effectuate such cure at any time prior to the expiration of said five-day termination. Upon terminating this lease as provided herein, Landlord or his agent may commence proceedings against Tenant for his removal as provided for by law.
    21. In the event of any breach by Landlord of any of Landlord’s covenants or agreements herein, Tenant may give Landlord ten days’ notice to cure said breach, setting forth in writing the manner in which said covenants and agreements have been breached. If said breach is not cured within said ten-day period, or reasonable steps to effectuate said cure are not commenced and diligently pursued within said ten-day period and thereafter until said breach has been cured, rent hereunder shall be fully abated from the time at which said ten days’ notice expired until such time as Landlord has fully cured the breach set forth in the notice provided for in this paragraph.
    22. In no case shall any abatement of rent hereunder be effected where the condition set forth in the notice provided for herein was created by the intentional or negligent act of the Tenant, but Landlord shall have the burden of proving that rent abatement may not be effected for the foregoing reason.
    23. Landlord agrees to deliver possession of the leased premises at the beginning of the term provided for herein. In the event of Landlord’s failure to deliver possession at the beginning of said term, Tenant shall have the right to rescind this lease and recover any consideration paid under terms of this Agreement.
    24. Tenant agrees that this lease shall be subject to and subordinate to any mortgage or mortgages now on said premises or which any owner of said premises may hereafter at any time elect to place on said premises.
    25. Unless otherwise provided for elsewhere in this lease, any notice required or authorized herein shall be given in writing, one copy of said notice mailed via U.S. certified mail, return receipt requested, and one copy of said notice mailed via U.S. first-class mail.
    26. Notice to Tenant shall be mailed to him at the leased premises. Notice to Landlord shall be mailed to him, or to the managing agent, at their respective addresses as set forth herein, or at such new address as to which the Tenant has been duly notified.
    27. This lease constitutes the entire agreement between the parties hereto. No changes shall be made herein except by writing, signed by each party and dated. The failure to enforce any right or remedy hereunder, and the payment and acceptance of rent hereunder, shall not be deemed a waiver by either party of such right or remedy in the absence of a writing as provided for herein.
    28. In the event legal action is required to enforce any provision of this Agreement, the prevailing party shall be entitled to recovery reasonable attorney’s fees and costs.

    -He used a paypal account under the name of Mary Journeay to receive her deposit payment, so I would watch out for that name and email as well. Luckily my mom realized it was a scam before she sent him any more money. Here is the email “James Waynes” sent to my mom:

    Thankfully I found your site and did not fall for this fraud, after I found this too-good-to-be-true London 3 bd/3ba flat for 100 pounds a night, and corresponding with the “owner” Kenneth Paul of this London flat at Maddox Street, No. 6, London. I thank you for having this site up and running. He wanted a deposit via Western Union, which was my first red flag, then of course the price was way too low for that area, and so on.

Unfortunately I found this page day before my trip to New York just after I googled fax number I received from fake owner of the NYC apartment. Below I attach mail from this person who I have already noticed use different names. I hope this post will avoid anyone from being cheated. Before we send money and decide to rent this fake apartment I googled this person name and e-mail address and found nothing suspitious but didnt think of googling fax number!.

    We found this condo vacation rental available on craiglist in Key West, Florida, and sent an email to the owner (reservation.rentals@gmail.com) to inquire about booking it for a night. The reply came from a “Smith” who directed us to pay up a security deposit of $300 + 50% of the night tariff via PayPal, a total amount of $ 365. My friend, who emailed, did ask him for his name and contact details so as to speak with him, but he never replied with those details. For some weird reason, he wrongly mentioned our reservation dates to be a week, not just 1 night which is what we wanted, but the amount he expected was for the 1 night itself.
    We don’t know as yet whether this is a scam or not, but maybe somebody reading this blog might have some idea as to whether it is or not. The condo location and price seems a little too good to be true. What still makes us wonder is why the so called owner is emailing us from reservation.rentals@gmail.com (you would think he would reply from his own email address or something), and he didn’t give us his personal contact details.

    I’m posting the link which we found on craiglist for this listing. We would really appreciate it if somebody takes a look at it and let us know if this is genuine or fake. Thanks!!
